The short version

This summary helps you find your way. It is not part of any agreement; the sections below are.

  • Include the address or hostname, the time with its time zone, and your evidence.

1. Where to report

In short

Abuse from a site, app or address on Drasken Cloud goes to abuse@draskencloud.com. A formal content complaint goes to the Grievance Officer, and privacy questions to privacy@.

1.1 What Drasken Cloud is

Drasken Cloud is a platform where our customers run their own apps, databases and websites. We do not check what they run before it goes live; each customer is responsible for it under our terms of service and acceptable-use policy. We act when we learn of abuse.

1.3 The Grievance Officer

Complaints to the Grievance Officer follow the times Indian law sets. We acknowledge them within 24 hours and resolve them within 15 days. We act on a request to remove unlawful content within 72 hours for most content, and within 24 hours for content that shows a person in a sexual or intimate way without their consent. You may appeal the Grievance Officer's decision within 30 days to the Grievance Appellate Committee set up by the Government of India.

1.4 Abuse that is not ours

If the abuse comes from somewhere other than Drasken Cloud, we cannot act on it. Some customers send email through other providers: report spam to the provider that sent it as well as to us. A public lookup tool shows who runs an address before you write.

2. How to report abuse

In short

Email abuse@draskencloud.com with where the abuse comes from, when it happened and the evidence. One report per incident is enough.

2.1 What to include

Write to abuse@draskencloud.com in English and include:

  1. Where it comes from: the full web address, the hostname (for example a name under drasken.cloud, or a customer's own domain that points to Drasken Cloud) or the IP address.
  2. When it happened: the date and time, with the time zone (for example IST or UTC). For ongoing abuse, when it started.
  3. What happened: the kind of abuse and what it did, in a few sentences.
  4. Evidence: for spam or phishing email, the full message with all its headers; for attacks or scanning, log lines showing source addresses, ports and times; for a web page, its address and a screenshot.
  5. How to reach you, if you are willing to answer questions.

2.2 Tips

  • Send evidence as text or attachments. Do not send live malware: describe it, or send its hash.
  • Do not send passwords, or personal data the report does not need.
  • A report without an address or hostname we can find may be impossible to act on.

In short

Send a notice to abuse@draskencloud.com with the details the Copyright Rules, 2013 ask for. We act on complete notices and tell our customer.

You may own the copyright in a work, or hold an exclusive licence, and find a site on Drasken Cloud that infringes it. Send a written notice to abuse@draskencloud.com with the details listed in rule 75 of the Copyright Rules, 2013:

  1. a description of the work, with enough information to identify it;
  2. details showing that you are the owner or the exclusive licensee of the copyright in it;
  3. details showing that the copy on Drasken Cloud infringes your copyright, and that its use is not allowed by section 52 of the Copyright Act, 1957 or any other permitted use;
  4. where the copy is: the full web address or hostname;
  5. the person who you say is infringing, if you know who it is;
  6. your undertaking to file an infringement suit in a competent court against that person, and to give us the court's order within 21 days;
  7. your name, address and signature (an electronic signature is fine) and, if you act for the owner, your authority to do so.

When a notice is complete, we may disable access to the copy and tell our customer about the claim. Where the Copyright Rules apply, access stays disabled for up to 21 days while you obtain a court order; if we do not receive one, we may restore it. We may decline a notice that is incomplete or that we reasonably believe is not genuine. A false notice can have legal consequences for the person who sends it.

For a trade mark, patent or other right, write to abuse@draskencloud.com with the right, its owner, the address of the content and why it infringes. We consider it under 3.4 of the terms.

4. What happens next

In short

A person reads every report. We investigate, act on the smallest scope that stops the abuse, and may not tell you what we did.

4.1 We acknowledge your report

A person reads every report sent to abuse@draskencloud.com. We may write back to say we have it or to ask for more information.

4.2 We investigate

We check the evidence and find the resource involved. We look at a customer's content only as far as the investigation needs, as 4.3 of the terms allows.

4.3 We act

If the report shows a breach of our acceptable-use policy, we act under it:

  • Unless harm is happening now, we tell the customer and give them a reasonable time to fix it.
  • When harm is happening now, such as an attack, phishing, malware or spam, we may stop the resource at once and tell the customer afterwards.
  • We act on the smallest scope that stops the abuse, usually one site or app first. Serious or repeated abuse can lead to suspension or the end of the customer's account.
  • We keep evidence, and report illegal activity to the authorities where the law requires it.

4.4 We may not tell you the outcome

Our customers' accounts are confidential. We may not tell you what we did, or whether we acted at all. If the abuse continues, write again with new evidence and the same subject line.

5. Your details

In short

We use your details only to handle your report. We do not publish them, and we do not give them to our customer without your agreement unless the law requires it.

5.1 What we pass on

We may give our customer the substance of your report, such as the address, the time and the evidence, so they can fix the problem. We leave out your name and contact details unless you agree, or the law or a court requires us to share them.

For a copyright notice, we may give our customer the rights owner's name and the work, so they can answer the claim. We do not give them your contact details unless you agree.

5.3 We do not publish reports

We do not publish reports or reporters' details. How we handle personal data in a report is set out in our privacy policy.

6. Law enforcement and government

In short

Courts, police and government agencies should send requests through official channels to legal@draskencloud.com or our registered office.

6.1 How to send a request

Send requests from an official email address, on official letterhead, to legal@draskencloud.com, or by post to our registered office: Drasken Labs Private Limited, 416, Block C (Old No. C-196), Gali No. 7, Om Nagar, Badarpur, South Delhi, Delhi 110044, India.

6.2 What we need

  • the authority and officer making the request, with a way to verify them;
  • the law the request is made under;
  • the address, hostname or account concerned;
  • the period it covers, with the time zone;
  • what you ask us to do: remove or block content, give information, or keep records;
  • any deadline, and whether the customer must not be told.

6.3 How we respond

We check that each request is lawful and give only what it requires, within the time the law sets. We tell our customer unless the law or the order forbids it, as 4.10 of the terms says. We do not answer requests from foreign authorities unless Indian law or an Indian court requires it. You may ask us to keep records while you obtain an order; say what to keep and for how long.

7. Urgent harm

In short

If someone is in danger, call 112 first. Report child sexual abuse material to the authorities as well as to us.

7.1 Danger to someone

If someone's life or safety is at risk, call the police on 112 first, then tell us at abuse@draskencloud.com with "Urgent" in the subject line.

7.2 Child sexual abuse material

Report child sexual abuse material at the National Cyber Crime Reporting Portal (cybercrime.gov.in) and to abuse@draskencloud.com. Send us the address only: do not send, copy or download the material itself.

7.3 Cyber crime and fraud

For online fraud or other cyber crime, you can also report it at cybercrime.gov.in or by calling the national cyber crime helpline on 1930.
